Florida Kidnapping Laws
Florida Code, Section 787.01 defines kidnapping as, "…forcibly, secretly, or by threat confining, abducting, or imprisoning another person against his or her will and without lawful authority…" with the intent to hold for ransom, use as a shield or hostage, commit a felony offense, physically injure the victim, or interfere with any governmental function.
What are the Penalties for Kidnapping?
Kidnapping as defined in this section of the Florida Code involves the confinement of a child under the age of 13 and is charged as a first degree felony offense. This is punishable by up to life in prison, or by up to 30 years in state prison and fines up to $10,000.

Lesser forms of kidnapping are referred to as "false imprisonment" and include holding a person against their will but not for the purpose of collecting ransom, of causing injury or of committing a felony offense. False imprisonment in this sense is a third degree felony, punishable by up to 5 years in prison and a fine of up to $5,000.
