I am a Miami DUI attorney handling DUIs. Many people constantly ask me whether in the event they are arrested for a dui should they blow or refuse. What every client should know is the law and the consequence of either refusing or blowing and make their decision knowingly.
In Florida if someone is arrested for a dui they will be requested to provide a breath sample. In the event they refuse to provide a breath sample their drivers license will be suspended for 1 year for a first Dui. If they were to provide a breath sample and it was over the legal limit of .08 the suspension would be for 6 months as opposed to 1 year for refusing.
In addition if someone has had a prior refusal to provide a breath or urine sample then a subsequent refusal can become an additional crime.
